What is a COP3 Assessment?
A COP3 form is required by the Court of Protection to confirm whether someone has the mental capacity to make specific decisions—often around health, welfare, or finances.
Often, individuals are advised to begin this process by a medical or healthcare professional, when a family member is receiving care for medical conditions. You may have been told to begin this process by a doctor or care home professional.

We will consider every case individually, but in theory, assessments can be carried out via video call. As long as we are confident that the individual can confidently communicate online, we are happy to support this.
During a COP3 mental capacity assessment, our assessor will engage with the individual to determine whether they can understand, retain, and use or weigh up the information relevant to the specific decision at hand. They'll also assess whether the person can communicate their decision—by any method available to them.
Our experienced assessors are trained to support individuals throughout the process, using clear and appropriate language, and checking for understanding. Where needed, they may rephrase or repeat information to help the person engage meaningfully with the decision-making process.
If someone has difficulty communicating verbally, we collaborate closely with speech and language therapists and case managers to ensure the individual is given every opportunity to express themselves. This could include using sign language, eye gaze technology, talking mats, visual aids, or other alternative communication tools.
In cases where communication is limited, we may also speak with the person’s main caregiver to gain further insight into their ability to make informed decisions.

There is no legal requirement to use a solicitor for the COP3 mental capacity assessment process. Forms are available via the gov.uk website and private individuals are able to fully complete all required steps themselves after they have received an expert assessment. However, many people wish to contract the services of a solicitor that specialises in these cases to avoid lengthy time delays or additional costs, should applications be returned due to problems with form completion.
